Am new to the forum and would appreciate some advice: I am wondering if I have a case for small claims court.


Who do I want to sue: A dentist
Why? I made an over-payment to the dentist.
What I have: An itemized estimate/statement; my cancelled checks, an e-mail from the dentist agreeing that this segment of the work in questions was not done (as it was not necessary) and that he owed me for the over-payment.
What I have done so far: E-mailed and sent him a letter requesting the refund, which he has ignored. I have signature receipt on the letter.
Amount: $1,000 – I paid this dentist a total of $28,000.

Appreciate any help the forum can give me. THANK YOU!

Thanks! How would I characterize this? As a contract default, bad debt??
Small claims is a relaxed forum. You don't have to characterize it as anything other than he is refusing to refund the overpayment.
