Sueing law enforcement officer

What is the name of your state? Arizona

A federal agent legally searched my home computer looking for the sale of a non narcotic medication. During his search they found adult pornagraphy on my computer (who hasnt looked). He notified my employer that he found adult pornagraphy on my home computer which had nothing to do with his investigation he told my employer to look for adult pornagraphy on my work computer for no other region other than to inflict as much pain as he possibly could. Of course nothing was found on my work computer, he did this out of shear malice becuase his legal search found nothing and proved I was innocent of the allged crime. Can I sue this guy for intionally defaming my name to my employer? I have this in his report.

Can you sue? Yes, absolutely.

What has a greater chance of happening, you winning if you sue or you growing a coat of fur in the next week? Well, let me put it this way. I'd start pricing hair clippers if I were you.

Don't you need the accusations to be FALSE in order for it to be defamation? The agent gave TRUTHFUL information about what he found on your home computer, based on the information that you provided. So how did he DEFAME you?

My question is even though the agent didn't find what he was looking for in the computer he must have had a good reason to search there. What was this guy doing to actually cause the agent to be granted a search warrant. I guess I am more interested in what lead to the search rather than him wanting to sue the agent.:)

o.k. but as the poster said, it was a legal search and as a consequence of the legal search, in plain view, the porn was found.

The only germain issue is why would the agent inform the employer. As I would suspect, there is MUCH more to this story which means it's a waste of time for anyone to answer and keep the thread alive when the poster is not honest and/or forthcoming.

I can see that it may be supect that I am not being honest, the bottom line is this. The search was legal looking for the sale of nonnarcotic prescription medication they made one controlled delivery. The result from the court was a plea for buying a non narcotic medication over the internet, I paid a small fine end of story. The agent went to my employer for no good reason other than trying to bring to the attention of my employer anything that may jepordize my employment. The information he gave was that adult pornagrapghy had been viewed on my home computer which had nothing to do with his case. I would agree with law enforcement had they had any probable cuase to think my work computer was being used for anything but for work however, he had none at all. This is proven in all his reports.

Yes, once the prosecutor deemed the unwarranted search by law enforcement of my work computer was in fact illegal. Further, the action by the agent intenionally lead to the misleading of a majestrate in order to issue a legal warrant for my home PC which proved that no sale had taken place. The prosecution immedialtly agreed to the plea deal once it became beyond a reasonable doubt that in fact that the agent was misleading in his testomony and affidavit.

And this happened over 2 years ago?

Likely the statute of limitations ran out even if you did have standing to sue although it doesn't seem that way.
