We contracted a photographer/videographer for our wedding in Pa in July 2009 (we live in NC). We got two CD's with all the pictures he took but never received the video, neither did we received 1 large wedding album, 2 medium albums, and a 6 month "Wedding Highlights Streamed online. We paid over $2,000. He stopped answering our calls and e-mails. Our aunt went to talk to him last month and he told her that he would mail everything on Sep 5, 2010. Still we have not hear from him or receive anything in the mail.

Part of the contract states "If complications should occur which woud prevent __________ from delivery of any and/or all video or media named above and/or any other oredered or named services herein for any reason, the liability shall be limited to a full refund of all deposits and payments paid for the respectiv services named or ordered" Do we have a case?

Thank you!

You have a case for potentially as much as your full payment. Failure to produce for a one time event like a marriage can have significant (lost) value. The contract does limit this to what you paid, although it might be argued that interest and legal fees can also be collected on top of that if he fails to "make it right" on his own.

Ask your aunt to visit him again saying "I'm here to pick up all the stuff today that you didn't mail on the 5th as promised".
