What is the name of your state? NC I paid my carpenter$150 about 3 months ago to build an item to go in the kitchen. He said that he would have it completed before we moved into our new home. He failed to do what he said and it has been over 2 1/2 months since we moved into the new home. I have called him (many times: he never calls me) to find out when he can deliver. He always has an excuse. Anyway, he said that because he failed to deliver as promised then I would not have to give him the remaining $150 upon the job completion which was suppose to be 2 weeks ago. This job will cost about $600 to complete by any other. This guy decided to give us a break because he built our kitchen cabinets (and he did a fine job in a timely manner). Can I sue him for the $150, filing cost, plus what it is going to cost me to pay someone else to do the job which he agreed to do?

Sue in small claims court for the dollar amount of the actual and direct damages you suffered (i.e., $150.00).
