Took deposit...will not answer messages

We put a $1,500 deposit with a local fence co. on July 5, 2005. We can not get a hold of them, nor do they return phone messages, or messages left with their answering service. We sent them a fax stating we wanted our $ back by 9-13, because they have failed to install the fence in the time quoted. We do have a contract. Which is the best course of action to take, to get us to getting our money back. We have already filed a complaint with the Better Business Bureau. They have numerous complaints against them with the BBB (after we gave them our deposit). Do we file with the Attorney General or should we take them to small claims court? Either way...will it be hard to collect our deposit back? We never thought in a million years we'd ever be in this kind of situation. Thank you for your advice...
