What is the name of your state? DEL.

i had alot of my stuff at a friends house or so i thought he was a friend. we had a fight and this fool threw all my stuff away in the garbage. i was never able to find any of it.

very valuable stuff like jewlery and crystal and clothes. plus he threw away all my court papers away also. i dont know what to do except to call the police and file with small claims to sue him for the cost of everything he tossed.

my question is what can be done about the court papers he tossed can he be arrested for throwing away court papers that arent his? there was court papers i needed for court that i cant get back. plus with all the valuble stuff can i file to have him reimburse me for the cost of everything he threw away. theres was easily over a $1000 in everything. clothes,jewlery,crystal,personal hygene and make up, etc.

i am so upset he threw away stuff ill never be able to get again. pictures of my son and grandparents and such. erreplacable items :(

why would you ever leave irreplaceable items anywhere that is unsecured?

Why would any one throw away items that were "very valuable"?

Did you have an agreement for storing your things there?

well me and my boyfriend moved in a new place with another friend and i didnt have room for everything at the time so this friend said i could leave my stuff at his place as long as i wanted. and i thought my stuff was safe there. and dont ask me why he would threw my stuff away. that will be something he can answer to the judge.

im plan to sue, is there anything i should be aware of and is there anything i can do about losing pictures and court papers? im very depressed aboutt his and cant believe he would do this. the more i keep thinking about it the more i realize this friend needs pychological help. how the hell do you just toss someones stuff? over a fight i will never be talking to him again. except when we end up in court.

someone tell me what i need to expect or do to get reimbursed for everything he threw away. i have started by making a list of everything i lost down to its description and cost. whtat else do i need to do or have?

you need to be aware, that even if he is found responsible, and that is a big IF, you will not receive replacement value for the items. As for court documents, there is no way to assess a value to those, they may be priceless to you, but to me they are worthless. You need to rent a safety deposit box and keep your valuable papers there, like other people do. You can file in small claims, you will need to prove that you had an agreement with him to keep your property there. Were you paying him a storage fee? and then you will need to prove what was there, provide purchase receipts for those items, and assess a present value to them. For example a leather jacket you bought 2 years ago for $200 dollars is probably worth $25 at best.

How long had your stuff been at his house?

Your first post said you had a fight with him and he threw out your stuff. Your later post claims you don't know why he threw out your stuff. Was the fight over storing your stuff? Did he tell you to get rid of your stuff or else?

there was no money arrangment he said i could keep it there for as long as i want. he said he had the extra room.

so basically your telling me i lost all my stuff because he's lost his mind by tossing everything i own in the garbage and i cant get money back for any of it?

when i said i dont know why he threw my stuff out, i meant i dont understand why or how he could do that. someone that just takes all your personal possetions and tosses them without a thought or think of what they are doing has serious mental problems. like i said before i will never be talking to him again.

as for receipt of purchase most of the valuables were christmas gifts and jewlery from my boyfriend. i have no receipts. :( either way im takin him to court some how he has to be responsable for it. i could understand if his place burned down i would take the lost but the Arse threw it away and to me that makes him responsable .

any other opinions on how i can make this run smoother. i was thinking i plan to have an officer escort me to his house and ask for my stuff and let him explain or say to the officer what happen to it all. would that help?

NO , It's a civil matter and If you file suit , you have the burden of proof , the other party damaged you and for what amount you claim .

now if i file civil how does that work? and where do you file at? unfortunatly i dont know the difference between civil and suit?

i know if i file suit ok yes ill have to prove but what id liek to know is if i file civil what am i filing and how does a civil suit work?

please give in depth detail on how this works so i can decide what to do.

i am talking to him at a minimal basis to try and see if we can come up with an amount he will pay me back for my lost stuff. he does admit he was wrong for doing it and wasnt thinking at the time. but i have a feeling he'll drag this out and right now im just want to finish this and not talk to him anymore .

you need to make a detailed list of the missing items and the value of those items.

Then consult with an attorney who specializes in civil litigation and find out how much it will cost to file suit and if you have sufficient evidence to win your case.

You shouldn't " Think " anything .

When you go into Court , the Burden of Proof and Truth falls on YOU , as you Petitioned .

If He admits the things on the entire list , the better , but then the Judge has to have some Idea on what the Items are worth today , and what they were then .

Better start some research and get really good details written down of the Items , and their worth when new , and hope He doesn't dispute them .

If you don't , even if He admits He threw the Items on the list out , the Judge will decide , and the Judge isn't going to do the research , that's for sure .

You would wind up with hardly what they are worth today , " IF " the Judge rules in your favor .
