Hello fellow members. I have a question regarding a possible future small claim. I purchased a car online, in which the seller stated it would have new brakes. After picking up the car my mechanic found that the brakes were not NEW and actually in bad shape. Can I sue in small claims court for repair cost and possibly win, as the seller totally misrepresented the car in their auction description? What evidence should I gather in my defense?

Yes this was a local purchase, payment was made via a Cashiers Check.
