What is the name of your state (only U.S. law)? california
My significant other is dealing with a legal issue where he is threatened to be sued by a third party. Long story short, a person he had known for years had loaned him money throughout their friendship however her terms was that he does not have to pay her back unless he he continue to see her whenever she wants him too. Well he had limited his contact with her and she asked for the money back, both of them had drawn a contract where he will pay her $250 each month under the circumstance that she does not contact him via email or text. Recently, she had decided to void the contract in writing indicating that he does not have to pay her back anymore, well she being harassing him again and he asked her to stop. Now she is threating to press charges against him stating that he had taken advantage of her. And she is requesting for the payment again.
Question, does she have the right to start the contract again since she had already voided in the first place? If it was taken to court, will she win? What rights does he have?
Please note: No sexual activity was exchange.
