I have a friend that entered into a verbal contract with a home repair person to do some renovating. She was told the job would be $10-$12 an hour. She has nothing in writing from him and he is now coming back and telling her it was $15 an hour and the amount he is actually giving her comes out to more than $15 an hour.
She has paid him $2400 and he is wanting another $1000. He is threating to take her to small claims court if she doesn't pay him.
There is NOTHING in writing, nothing saying what he was going to do, nothing about the cost.
She told him she doesn't owe him anything and she is not happy with the quality of his work either.
With it being his word against hers, no written contract, can he sue her in small claims court.

*** Of course he can sue her. Whether he will win or not depends ENTIRELY on what evidence he can present to the court.... and what defense your friend can offer.
