'veWhat is the name of your state (only U.S. law)? GA


I was awarded a judgment in cobb county GA magistrate court and I've gone through the process to have the defendants wages garnished. His employer who is the dept of correction has not garished his wages. Is the dept of corrections and thier employees exempt and above the law from court orders?

Georgia state employees are not exempt from garnishment laws. In GA, a maximum of 25% of the garnishee's disposable wages can be garnished. However, if there are multiple garnishers, or if perhaps this person has other after tax deductions coming out for example, child support, this could be why the garnishment cannot be served.

Also, in GA it does not automatically renew until the judgement is satisfied which makes it more cumbersome. Check with the court that issued the garnishment and find out what the status is they should be able to give you the specifics.
