When the person I'm suing lives far away...My ex-roommate and I signed a 1 year lease agreement to our last apartment. He decided to move to Chicago (I am still in Florida) one month before the lease ended with the promise to send me the last month's rent in the mail. That was almost 2 months ago and he has not sent anything so I have decided to take him to small claims court. Keeping in mind the distance, what would happen if he doesn't show up? I've read that the court doesn't collect for me, if so what guarantee to I have of receiving my money? Thank you!What is the name of your state (only U.S. law)? |

| I was in something similiar and if the defendant doesn't show up for court on the scheduled court day, you will win by default and the judge will rule in your favor and issue you a judgement. They will not collect the $$ for you, but if you can do searches and find out where the person works, you can file a garnishment to garnish their wages for the amount owed to you. greenda4 |
