I appreciate anyone reading this and any comments they have.

I have a shop in the ground floor of a multi-tenant building. A condo unit upstairs had a bad leak 9 months ago that caused some damage and my business to shut down for 2 1/2 days.

The HOA has taken care of repairs to the building, but I've not been compensated for personal property or loss of business. I've send out multiple inquires to the HOA and Home owner's insurance. After much stalling, the HOA says they've closed the case and to contact the homeowner's insurance. The home owner's insurance send us a check for $500 saying it's the HOA's fault. I've not formally accept the money nor have I cashed the check.

I have a couple of questions:
1. Who do I sue?

2. How should I serve the paperwork and can I include the cost of a professional server as part of my claim?
