I had loaned $800 to my ex and he signed and dated a paper that stated: 5/19/2004
I (ex) agree to pay (me) the $800 with intrest 1 year from this date which will be $900 by 5/19/2005
ex(signature) 5/19/2004
my(signature) 5/19/2004
If he does not attempt to pay the money can I take him to small claims court?
Or do I have to wait until after that date and then I can sue right? He had also damaged my car by punching the windshield and dashboard. If I didn't file a police report, and there was a witness can I include this in with my small claims?

Each issue is separate and will have to be taken care of in separate lawsuits. You will have to wait till your contract is in default to sue.
