Confused about back child support and SSI/SSDIWhat is the name of your state (only U.S. law)? Maryland Hi, I've got a few questions regarding my ex informing me that he was recently approved to receive SSDI beginning October 2009. A few weeks later he informed me that SSI will start immediately until SSDI kicks in. Once SSDI kicks in, SSI will stop. My ex has 50K in child support arrears. I did go to SSA and they confirmed that my ex will receive SSDI in October but did not say anything about SSI and for me to go to MD Child Support for a garnishment. I understand that SSI cannot be garnished for back child support and in fact, that any arrears will be erased. I also understand that SSDI can be garnished for back child support. My questions: 1 - Does SSI normally pay until SSDI kicks in? 2 - If SSI does pay temporarily, will arrears automatically be erased? 3 - What percentage will be garnished from SSDI once it begins? Thank you for any help and answers, I appreciate you taking the time to read my post. |

| If Dad is going to get SSDI, then the children will be eligible for dependent benefits, as well as backpay. You will need to check with the SSA to see about how to get these things in the works with you as the representative payee. The amounts for the dependent benefits can be applied to his CS payments. You will also need to contact the agency handling your CS from Dad and let them know what's going on.

| As far as arrears go , talk to SSA also about garnishment.
