What is the name of your state (only U.S. law)? Texas

I have a close friend who is currently separated from her husband, and her husband somehow manages to receive her Social Security disability checks as well as their sons Social Security disability checks every month. She has spoken to a representative who said that she needs proof that the child lives with her with written proof, or just proof in general, from the husband. Now her husband is not the type of man that would give up his opportunity to basically be getting free money, in which he won't be willing to provide proof that their son lives with her. What other legal proof or legal process can she do to fix this to where she can receive her checks personally as well as her son's checks? (Keep in mind, the child is 5-6 years old.)

If she cannot simply have her own checks sent to her it suggests she requires a representative payee. If so she is not going to be able to be the rep payee for her son.

If there is no problem with her receiving her own checks she needs to make that change now. Then she can work on proving the child lives with her.

A court order for custody would be a good place to start

I would suggest she open a separate bank account and have the checks direct deposited.
