My husband has joint custody of his 6 year old daughter, however we have primary parenting time with her in our home more than 55% of the time. She attends school from our home (ex lives in different town 45 miles away), we supply all school clothing, school supplies, school lunches and basic needs for minor child while in our home. Recently his ex was approved for SSDI disability based on her earnings, the minor child will also qualify, ex the representative payee for the child. We are considering applying to have the representative payee changed to my husband and are wondering if anyone can tell us how likely SS will be to change it. If anyone knows what the guidelines are and what SS uses to determine which parent should be the representative payee. One thing to note is that she has not begun receiving payments for the minor child but will be shortly and benefits will be paid back to July 2006. Most of that time we have had at least 50% parenting time and have been required to pay her child support. As of May a Judge ordered that we are the primary home and are no longer required to pay child support. We would like to have an idea of our chances before we pursue, we don't want deal with the possible storm the ex is going to have if our chances are slim, however we would like to see that the SSI benefit the minor receives actually gets used to support the minor.
