What is the name of your state (only U.S. law)? Georgia/ will it affect my SSI check if some one claims me on their tax return?

For someone to claim you as a dependent on their tax return means that they are telling the IRS that they are providing 1/2 of your support. Is this person really providing 1/2 of your support from their own money? Do they spend the same amount of money on you as you get from SSI each month? Is the money they spend on you for your food and shelter? Or is it for other things?

Or does this person claim you as a spouse?

SSI counts food and shelter support as income to you. If this person doesn't provide 1/2 of your support, they are committing IRS fraud and you would be colluding. If they do provide 1/2 of your support, and some of it is food and shelter and you are not reporting that to SSI, then you are committing SSI fraud.

Will it be discovered? Maybe.

That won't strictly trigger it, but there's certain relationships that are counted against you whether you are a dependent or not: Your spouse, your parents (if you are under 18), you're sponsor (in certain immigrant relationships).

Good point Onderoek, that is 100% correct. Food and shelter is NOT excluded from the income test.
