What is the name of your state (only U.S. law)? N.J. If a collection company is sueing for unpaid credit card debt and your only income is SSI diability and you have a representative payee what can they do they have to sue the rep payee?:

No they sue the person that has a contract.

Having said that , if the collection agency ( not the Co.'s collection Dept .) contacts for collection , or the Co. threatens to sue , and the SSI beneficiary has no other meaningful assets , they simply respond that there SSA benefits are exempt from seizer and they have no assets worth anything .

The Rep. payee has a Duty to pay the beneficiary's basic living needs , so much a year for clothing ,etc .

CC debts are not a necessity.
