What is the name of your state (only U.S. law)? New York
I have been out of work for about 10 weeks due to extensive bilateral lower extremity injuries caused by a fall (not work related). At my ortho appointment last week I was released to work with very limited ability. I informed my employer, however they have been away on vacation so they have not responded. I can return to work tomorrow. Due to the nature of my job I am not sure that the limitations would be prudent, but I felt I needed to try to return in some capacity in order to not lose my job. If my employer decides the limitations are too strict and they have no position that I do within the limitations, will I continue to receive disability?
