What is the name of your state (only U.S. law)?
PA state-Got a question for the experts in the field of Social Security Disability.
I have been receiving SSD since 1985. For two years now, I have been trying to change the decision-illness-from mental disorder to physical diseases which I have numerous disorders and three out of the four qualify for disability. The mental disorder in 1985 was a nervous breakdown; true I was on many meds and seeing specialists. I have not seen a psychiatrist or psychologist in 8 years. I function with mental capability, no sign of mental disorder and states so in numerous regular physicians reports since my adding a Living Will Health Care Power of Attorney. I contacted SS Disability to have it changed-reason being, I do not have a mental disorder and suffering from various physical diseases and disorders. The office told me I could not change the illness that is on paper; and to get off it and re-file for physical, which take up to a year in waiting.
This would mean no benefits I receive monthly now and have the medical coverage to go to specialists, being I cannot work.
I even have a Living Will with my husband as medical power of attorney, signed and notarized with a "Combined Mental Health Directive Power of Attorney", stating I am not adjudicated, incapacitated and have the ability to understand, communicate and the capacity to make mental health care decisions for myself.
Is there anyone that could help me-advice or opinion. For those who ask why would I want to change it-ask yourself this. Would you want to be labeled something you are not? If you do, I suggest you go to hospitals, physicians, specialists, etc., and explain to them why they have it on the medical records which follows you for life. Treat you differently-I know; been a living hell.

You have disability benefits, and you want to change them, because?

The best thing to do is to add medical evidence to include your physical disability assessment for review.

You can not erase the fact that your original disability assessment is for mental disability.

If a CDR is initiated, you could report that you have recovered from your original illness/diagnosis and that you now have a new disorder. During the CDR, your medical evidence will be evaluated to see if the orginal diagnosis code can still be supported by the evidence or if you have a newer condition that is severely diasabling. It is possible that your newer, physical only conditions may not meet the criteria for being serious enough to continue to be found disabled. And benefits could stop. Or maybe they will. And benefits continued. SSA is not going to change the diagnosis code unless it is part of a finding of whether or not you are even 'disabled' within the legal SSA definition. And at your age 58 and years of entitlement, 25, it is doubtful that a full CDR will even be considered by SSA unless you report medical recovery.

You can't change history. You can't force a change in a diagnosis code either. Your local office won't do it. The DDS will only do it as part of a full review which could result in a cessation of all benefits.

Onderzoek, I wish to thank you for your advice. Very helpful and now know it is useless to even try at this stage. I very well know my physical limitations and disorders will meet the criteria but cannot afford financially to take the risk of losing the benefits, especially medical bills for specialists. I am stuck with the label that has marked me as mental and live with it.
