What is the name of your state (only U.S. law)? missouri

Personal injury settlement**************will Medicaid seek reimbursement from possible future settlement for monies paid ? Reimbursement for all bills paid in the last 7 months since I've received Medicaid. Will SSI also seek or demand reimbursement ?

Had Medicaid a few months.
At 59 I'm blessed with all these: Heart condition, Vascular disease, several surgeries, Diabetes, Neuropathy in legs and arm, can't close left hand, back operation which didn't go too well, pinched nerve in neck, on pain management. Lost private Health coverage and I just may need the Medicaid in the long run far more than the amount I'll probably get. $35-55K net. That much could be spent on a single car.
Couldn't pay off credit card after being hit, then only $2K, which has quadrupled and they're sure to want their share, although the letters and calls have long ceased.
It may just be in my best interest, medically to refuse to settle, if I can......
Any input? Thanks~!

You say you already filed for Medicaid and SSI? If so, you have a caseworker. Speak to your caseworker. Ask what will happen if and when you receive a settlement. If you have money coming to you, you probably are required to get it, even if Medicaid gets some of it. You can't just elect not to get the money so you won't have to pay Medicaid. Again, ask your caseworker. Receiving a lump sum of money may just kick you off the program for a period of time, and then when your income is once again insufficient in relation to your medical expenses you can come back on.

It always makes me ill when I see these reality shows where they try to "help" some poor deserving needy person, usually with a lump sum cash gift, which is not anywhere near sufficient to cover the devastating medical expenses that made them needy in the first place. All it does is mess up their Medicaid and SSI, and as you said, will be gone very quickly, and then the needs and health issues will still be there.

Thanks for the reply. Medicaid isn't all it's cut out to be in some people's mind. It's nothing like private health care~! No doctors will see me because I ONLY have Medicaid, they'll only receive 2/3rds of their regular pay and all openly profess to be good Christians, which annoys me. It's not all the FREE Medical one needs as those who aren't on it sometimes believe. It's a step above death. I only wish I was able to work. As far as SSI, I can afford to leave the house twice monthly for groceries, if the car runs and have a 16 Y/O son living with me. Plates are due and there's not enough money left to get them and I live in the country. My minor son's settlement $10K alone will knock me off which has to be in my name and it's "his money". No good father would touch his money.
I even opened a savings account for him when he was 13 and SSA counted it as my income which took me over the $2K cap by $0.11 CENTS for 6 months of back pay or whatever it's called.
All I was trying to do was show my Son the value of saving his money. I never tried to apply for SSI for him, don't wish to and his Mom pays the state $134.00 a month for child support.
I don't see how I can be forced to settle or sign my name, even a gun point. I'm a rather extremely stubborn old man.
I told this lawyer to drop the whole thing many months ago as he'll be getting by far more than I would and I just forgot about it. I even used a few carnal verbs. I told him "let's make a new deal where we both get nothing and that's final**************.click"
I have no idea if I have a case worker and received a copy of a letter from the lawyer for his demands on the Ins Co 2 weeks ago. To which I wrote that I stand firm on not settling. For the first 30 days, when I could have gotten a new lawyer, he called me almost daily with how much money "I" would get, going to trial etc..then he never called again.
He just wants his 45%.
All this is disconcerting at best......
I could easily spend the entirety within 1 month or less. I could actually spend it all in a single day by getting dentures, seeing doctors who refuse Medicaid, the one I now see in cash and a better vehicle.

Don't you have to recertify periodically for your Medicaid? If so, there will be someone you have to talk to, someone who does your certifications. If not, call them and ask who your caseworker is. Or just ask the general question about how it will affect your Medicaid if you were to get a cash settlement from a lawsuit, what about other bills you owe, other expenses, etc.

If it was something you and your attorney filed, I would say that it was not mandatory that you continue this case...but I would assume that there was some way you could work this in coordination with Human Services instead of refusing it, and still keep your Medicaid eligiblity and perhaps use this money for more beneficial things. Ask if they can give you some guidance, because you know that you are not the first person on Medicaid who ever got a settlement.

Yes, Medicaid did have to count any savings account that you had in your and your son's name, it's the way the rules are written, your intentions when you set it up or anything else are not what they go by. I'm glad you said what you did about all these fine religious doctors who are fighting against health care reform who refuse to help patients on Medicaid for financial reasons, certainly not moral ones.

Yes, it does sound as if you are a stubborn person, there's nothing wrong with that, but don't be "stupid stubborn" or what my mother called "cutting off your own nose to spite your face." Even though the attorney would be getting 45%, you'd still be getting 55% and that's better than a sharp stick in the eye anytime. Even if you have to give up your Medicaid for a while, you would still be eligible when you have spent the money and need it again, and you would have some money you had control over, and could really use.

I didn't know I had anyone to ask until now. Well, I'll do just that~! I've only had this stuff a few months, the SSI stuff.

My Dad's words, "better than a sharp stick in the eye" indeed. Medical bills come After his pound of Flesh. I'm happy to bring it up and maybe bring forth a deluge of debate / opposition on the Morality of health Care in the only Industrial nation which doesn't Care for its People. "In God we Trust". Christianity or Cosmetic Christianity seems to be only a veneer when it comes to Goodness or rather good deeds. I know this one and only one Medical Professional on a personal basis who told me "they're good doctors, just not good people" about other doctors. He treats my Son and I, plus many others for Free if needed and sees 1st hand just how bad Health Care is here. We have both lived in other Developed countries. Told me the AMA spends Billions to keep it the way it is. There's an email floating around to frighten people on certain upcoming bills. Perhaps many here will receive it or already have. I can't attach the email (could but won't) but this is the intro, which as you can see, will forewarn those where to refute their facts. The email chain letter sender is very Religious. Don't believe links are allowed and not pertinent to the original post.
