Ssd


What is the name of your state?ms
I am out on bond since oct 2003 and am disabled and on SSD.My attorney says I will get probation.My Question is.I have drawn SSD since 1991 and have severe disability.Will I lose my benefits if and when I am sentenced or whatever happens?I was never locked up,just booked and bonded out.The so called charges were 3 counts of sale of controlled substance.I have had no hearings whatsoever.All help is appreciated.

The only way SSA will stop your benefits are if you are incarcerated 30 days or more .

Also , I'm not sure if the can stop SSDI ( from work history ) , I know they will SSI ( State Funds ) .

That is correct. My husband gets SSDI and reading the paperwork there doesn't seem to be a difference on the benefit it you are incarcerated.

Per usual most of SS things sometime seem are in a different language. The first line says that SSI and SSDI are treated differently and it goes on to say that SSI benefits do stop.. but then later on says once you are not incarcerated anymore you should contact someone to restart payments whether it's retirement, disability ... etc...


So, if you just base it off the question itself I guess it means that SSDI payments aren't stopped... hum...

I thank you for the in-put.I want everyone to know the story behind this.I lost my wife on April4 2005 to cancer.She was having her care via the VA health care system.She was not being adequately treated for her pain,no matter how much I asked.I have been a chronic pain patient for years(10 back surgeries)and was seeing my dr.So dumb old me went to another dr. to get her the meds she needed.They busted down my door and found exactly how much medicine should be here and no money,believe me about the money.They threatened to also take my wife to jail unless I told them I was selling the drugd.So I did.That sounds so stupid,but that is the Gods honest truth.
