SSI/SSDI Question

What is the name of your state? Ohio.

I've been getting SSI for over a year due to my cancer diagnosis &
bone marrow transplant. I didn't work for 1 year in 2006 and in 2007 I
attempted to work but I only worked for 3 days and had to be put on
another medical leave from my employer due to another health issue --
That is now connected with all the chemo I had gotten for transplant
and now I can't work until I get my doctors okay.

I got a letter from SSA in December which said in a nutshell that I could be eligible for
SSDI benefits and I only had until a certain date to apply (which is
all taken care of) or I wouldn't be eligible for SSI benefits. Here is what the letter said in a nutshell:

We are writing to let you know that you may be able to recieve Social
Security benefits. You must apply for these benefits by January 11,
2008. If you do not take action by this date: You will not be eligible
for SSI & you will have to pay back any SSI you may have recieved
December 2007. We will send you another letter that explains our
decision..what to do if you think their wrong yadayadayada. If you
want to recieve SSI payments you must apply for any benefits you can
get now. In some cases, you can get a lower benefit if you apply now
but a higher benefit if you apply later. You have to take whatever
benefit you are eligible for now in order to recieve SSI.

The social worker only brought up work related stuff when I applied and I
had to send him pay stubs through the mail for 2006 (this was medical
leave payments) & 2007, so maybe I worked enough to get the required
credits for SSDI? I was not eligible for SSDI when I applied in 2006.

Will I still get my SSI benefits while I am waiting for a answer from
SSA & will I still get my SSI checks even if I get a denial letter about the SSDI?

SSDI benefits. I'm not sure what it means excatly, so I'm hoping you
kind folks can help me once again. :D

"You are entitled to monthly disability benefits beginning December
2006. We found that you became disabled no earlier then 12 months
before the month of filing. Since you filed for benefits on December
18 monthly payments will begin December 2006.

You will receive $xxx.00 for January 2008 around Feb 1. After that you
will receive $xxx.00 on or about the third of each month. The
following chart shows your benefit amount before any deductions or
rounding...the amount you actually receive may differ from your full
benefit...deducting Medicare premiums.

Then the chart is like..

Beginning date Benefit Amount Reason

December 2006 $xxx.20 Entitlement began
January 2007 $xxx.70 Credit for
additional earnings
December 2007 $xxx.70 Cost of Living
Adjustment

We are withholding your social security benefits for December 2006
through December 2007. We may have to reduce these benefits if you

I think what it means is because you were receiving SSI , they will adjust any back pay of SSDI accordingly . meaning you wouldn't get full back pay for each month of SSDI .

After Dec. 2007 , you will be entitled to your full monthly SSDI payments , plus if your State allows , you may also receive a small SSI supplemental allowance .

You must have earned the additional credits to qualify for SSDI when you worked .

Medicare kicks in 2 years after SSDI eligibility .

Since it says "You will recieve $xxx.xx for Jan 08 around Feb 1, 2008/ After that you will recieve $xxx.xx on or about the third of each month"... does this mean that I'll be getting two checks soon? One for Jan and then the other one as my regular Feb payment?

Unlike SSI , SSDI is delivered on the 3rd of each month ( unless early because of weekend or holiday ) as long as the payments are in check form , so yes you will be receiving two checks .

Since I've gotten SSI for so long, and I've read I can get both SSI + SSDI at the same time, would I still be eligible for SSI. SSDI is awarding me $489.00 a month. Would the letter have said I would still get SSI or do I have to reapply for it?

You should now receive both with no problems , except for occasional reviews .
Your SSI will be less now of course.

is in the system I'm getting SSDI bennies). I am not going to do
anything with the SSI check I know I'm going to get a letter that is
gonna be screaming overpayment, when it's their fault they printed it
that way. ^_^; I am going to be getting SSI still but it's going to be
a lesser amount, I forgot how much (chemo brain) but less then $637.

Since they knew I started to get SSDI benefits, and they didn't fix it on their end for SSI and I do happen to deposit/cash the check couldn't I just appeal it and say it was their mistake, not mine? (I'm not going to do anything with it though!).

It is so annoying!

Check around the SSA site or call SSA back and ask them to explain for what months the payments are for .

If your SSI amount is more than usual, again ask them to explain .

You may very well be entitled to it .

I'm not up to searching for what months SSI are paid for , and what months SSDI are paid for , but here's a bit .

Social Security benefits are paid each month, but for the previous month. For example the check received in June is for the month of May.

When you applied for benefits, the Social Security representative told you when you can expect to receive your benefit payment. Your benefit award notice also has this information. Generally, the day in the month on which you receive your benefit depends on the birth date of the person on whose record you receive benefits. For example, if you receive benefits as a retired or disabled worker, your benefit will be determined by your birth date. If you receive benefits as a spouse, your benefit payment date will be determined by your spouse's birth date.

I'll just hang onto the check until I get a letter saying they did over pay me. Then it will say how much I owe, and then I cash it then and take out what is entitled to me, then pay back the rest. I haven't gotten a notice of payment letter for SSI yet noting the change, so maybe they made their decision recently. :) At least it is good for a year & this month is shorter then usual.

I was just re-reading back up the thread aways to your letter of entitlement , I had only read your last post when I replied ( my bad ) .

Anyways it looks like the difference in amount is your credits , and cost of living adjusments .

Look at the check , what month does it say it is for ?

Example: SSI for Febuary

SSDI Soc Sec for Jan

See what I mean by the months the are for ?

Also , let's just say if you were overpaid , they will only take 25% per check until recouped .

Visit your local SSA office if you are uncomfotable cashing it to have them explain .

I deposited the SSDI check today, the SSI check is sitting on my desk just staring at me. ^_^;;;
