21 y.o. traffic ticket

Greetings wonderful and versed legal advisors of America. My husband was issued a ticket for driving without insurance back in 1988. We live in Atlanta, Ga and never received any correspondence regarding court or additional fines. He has had suspensions on his license in Atlanta over the last year and there was never any record of this ticket. Bam all of a sudden he is pulled over last week in southern GA and his license is snatched for this 21 year old NYS suspension. Is this even legal? We can't imagine the number of fines that they have attached to this ticket. Please advise on how he should approach this matter and be vindicated.

Just because it was issued 21 years ago does not mean that it was supposed to go away at some point in time. If the citation was filed in court within the statutory period (for filing) according to NYS, then the citation is valid and must be handled in a timely manner (usually by the date written on the citation).

Usually, that is the only notice required by law... So for you to agrue that he never received any notification that he must handle this matter, will not get you anywhere. He was initially notified but for whatever reason he didn't.

He needs to contact NYS DMV for more information about the citation and which court it was to be heard in, contact the court, pay the fine (+penalty for not appearing + late fees), reinstate his driving privilege in NYS, get some sort of confirmation that the matter was handled, then contact the GA DMV to reinstate his driving privilege.
