22450A in San Diego CA


What is the name of your state (only U.S. law)? California

I was cited for a 22450A in San Diego CA at 10:30PM on a friday night.
Officer said I made a complete stop but over the limit line. While he wrote me up, every car I observed did the EXACT same thing. When I tell him this, he asks me if I have ever been fishing? Then he says you cant catch every fish in the sea. I told him yes I have been fishing but I always throw the little ones back in. This officer really bothered me, I made sure to tell him to write on the back of the ticket what was observed as he wrote the ticket. Also, the next evening I went to the same location and observed a different officer parked where I assume the officer who wrote me up was parked. SHe was parked ILLEGALLY IN A RED ZONE. Any advice on if I should challenge this? Thanks

You're supposed to stop before the line.
He doesn't need to write everybody up.
What was observed about what?
Why does the second cop have to do with anything?
Pay the ticket.

The cop was parked ILLEGALLY WHEN HE SUPPOSEDLY OBSERVED ME STOPPING OVER THE LINE. EVERYBODY I OBSERVED AFTERWARD STOPPED OVER THAT LINE. THE TICKET IS $203 DOLLARS.

AND THE LINE IS A GOOD 15 FEET BEFORE THE STOP SIGN AT THAT LOCATION.

So I just should bend over and take it like a man?
I think this "cop" discriminated against me, like I said EVERY car after me did the same thing. I believe the vehicle in front of me did, too. This cop saw my "older suburban and bam" pulled me over.
I want to fight this, it's injustice. If I go and take video of the same thing happening is that presentable in court? will that give me any chance? I apologize if I am coming across as whiny. Want to know what chance I have to get it dismissed. Thanks

Which is a violation of the section.

He was busy with you. He is not obligated to drop what he is doing and start stopping every car there. Plus, it is NOT a defense to your offense that others got away with it.

Of course, he is not obligated to write anything on the back of the ticket. It helps him later on to remember the event, but he does not have to do what you ask.

The officer's being stopped in a red zone is irrelevant to your ticket from a day before.

You are free to challenge the citation as you wish. Ask if the officer could see the limit line, if she will agree that you might have come to a complete stop before the line, something ... but arguing that others committed the offense is a loser, as is your observation that the officer was parked in a red zone the next day.

WAIT A MINUTE!!! Didn't you claim you were a little fish? Now you admit to driving a SUBURBAN!

I too will tell you that others breaking the law will not help you in court. And I wouldn't mention that the cop was parked in the red zone for two reasons; one, it doesn't matter and two, it doesn't justify you breaking the law at that same intersections, the previous day.
