| | 40mph over the speed limit, please help - what are court case outcomes? What is the name of your state?What is the name of your state? Illinois.
I was clocked at 109mph over 65mph, late night, clear conditions and visibility (no fog etc), no traffic, first ticket in a few years of driving. I knew I was driving fast at that moment, but I wasn't looking at the dial, keen as I was to get to the next exit for various reasons.
(I'm an unlikely person to get into this sort of trouble, and while I've learnt my lesson well since and am super safe, I especially put a total stop to driving long/tiring distances at night.)
I later realized that 40mph over was a class A misdemeanor and I could go to jail for it. I've hired an attorney and while he says the chances of jail time are less since I have a good driving record, he doesn't rule it out entirely. IF anyone has been in or seen a similar situation before, what are the chances of jail time? Have similar offenders in the past been given jail times?
Please help with any information... |

I do realize it was a bad mistake. I'm just trying to get out of a hole. The weather does not make it ok. Your replies to the last two specific questions does not make it easier on the mind, but thanks for taking the time anyway.
The reason I posted was I wanted to know if anyone else had been in or seen a similar situation knew what happened in these cases? Particularly if its a good record and first time offense. |

| | Considering your clean driving record, and your lawyer, you are probably looking at having the ticket reduced to 35 mph over the limit which makes it a serious moving violation (on par with speeding in construction zones, illegal backing on an interstate, or passing a school bus, basically the type of violations that require a mandatory court appearence) but which is not a class A misdemeanor. You will be fined somewhere in the neighborhood of $250 (Illinois traffic fines are much lower than other states) and be required to attend an eight hour traffic school costing an extra $70, and you will be placed on court supervision for between six months and one year (meaning you better not get any other traffic tickets in that time or else the original charge and penalty could be invoked). But you will not have a criminal record, and your license will not be suspened. Keep in mind, this is just a likely scenario, your outcome could differ substantially depending on the judge, prosecutor, and your lawyers competency. | |
