85mph an not me


florida

need some advice
i was on a interstate in florida an was running 65 in a 55 i was running with traffic i got cut off by a red pontiac i am driving a maroon one i had to tap my brakes my wife looked up and seen the car cut me off then she looked at my speed i was going 60 after that the pontiac was 10 car links ahead of me when i looked on my right i seen 2 officers with radar clock the red pontiac then i seen the officer with the radar gun point it at the red pontiac then point at the other officer to get him.i started laughting an told my wife they got him my 12 year old son was in the back seat and seen them pointing at the red car.i seen the motorcycle officer get on the bike an head down the ramp after the red pontiac well i meet the officer at the end of the ramp an got pulled over i told the officer he had the wrong car he replyed no the radar office said the red pontiac mind you mine is maroon an the ticket says red pontiac. so i got a ticket for 85 in a 55 i have a class a cdl with 2 millon miles logged an never a ticket in my life whats my odds in court with my witnesses against 2 officers if they show an dont they both have to show in court.

Florida CDL Speeding Ticket


This is a very serious CDL speeding ticket even though you were in your personal vehicle. If convicted you will have to report it to your company and their insurance might refuse to insure you which means no job. Then you will have a very hard time getting employment elsewhere. Since you have a CDL you are no longer eligible for traffic school although some courts in Florida seem to be ignoring the rule. I don't know what the DMV is doing when they get the report.

You have an fair chance of beating this in court. Both officers will have to show and testify or you can request dismissal. You also have your wife and child as witnesses. My guess would be 50/50. The problem is if you lose.
My advice woud be to retain an attorney that knows the court and the procedures. Send me a PM if you have further questions.

thanks for the reply.
follow up sent in plea of not guilty still waiting for court date have case number an looked it up on there records it only list 1 officer for court but the ticket has 2 officers names on ticket.the officers name on case number is the officer who wrote ticket not the officer who was running radar.i talked to a lawyer who has been to there court system 30 times an lost 1 time he said last time he went they won on the speed site survey was 6 years old for that location.not 5 years an under. so im going to try to beat it with my witnesses an my clean driving record of 24 years without a ticket.im self employed an not to worried about lossing a job because of points.i just dont want to take the rap for someone elses speeding.
