What is the name of your state?What is the name of your state? Ca.bumbum I am very dissillusioned now as many citizens are. I was ticketed for 50 in a 35 zone and I know ( because I am always harrassed and intentionally drive slow) that I was only going 37. I did not admit this to the officer, and I had been as always looking at my speedometer. He said that I was going 50 or 52. My daughter would have had motion sickeness if I was & she didn't. Nevertheless, I understand the the Sheriff's department in my area needs revenue with the cutbacks, yet now I am angry after voting for a pay increase. This was a absurd lie. I was on a hill/incline that is curvy with a lot of wind. He said his laser/ lidar tracked me. Nevertheless, it didn't track the truck next to me or the Suv right behind me that passed me quickly. What the heck is this? I tried to a trial by declaration, and I am sure I won't win. This was in a gated communities driveway. Do I have a chance with a lawyer? Is there anyway I can win this on my own? I don't want a out & out unhonest officer to get away with this! I have family in law enforcement and they agree that I should fight this, yet I am not wealthy! I am so shocked that this has happened. I am in Orange County Calif., I asked for a Discovery of Evidence since I can not find my ticket. Can You Help Me?

I would like to point out an inaccuracy in your post, it is a bad assumption that lots of folks make. The revenue generated from traffic tickets does not go the the police agency that writes the tickets. In most locales, it goes directly into the general fund. Others may allocate the money for specific areas such as courts, jails, roads, etc.

I would suggest talking to a local attorney if you wish to fight the ticket.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I can't believe you were always looking at your speedometer ... that would be patently unsafe! Most of us glance occasionally at our speedometer .. but, when proceeding down a winding hill/incline with a lot of wind, I would think your attention might have been on the road and not on the natural increase in speed.

They do not get money from this cite. The county MAY get up to approximately $22 per $100 fine, but this money is capped and the county almost certainly maxes out on this revenue every year whether they cite you or not. The revenue argument in CA is a dog of an argument because it is not true ... moving cites are poor revenue enhancers for local law enforcement - parking enforcement is where the real money is!

I Lidar can be aimed at a single vehicle and the tracking time is almost nil - much less than a radar, and it has pinpoint accuracy (it IS a laser beam). That's how.

You never know. But, if you lose, you have 20 days to file a request for a new trial (a trial de novo).
