Arrested for SpeedingThe laws in question are those of Georgia I was stopped for speeding by an officer, but instead of having me sign the citation and releasing me, I was immediately taken into custody. I had not been drinking at all, and the officer searched my car after handcuffing me and found no contraband either, but I was still arrested and taken to jail. My questions are these: First, is it lawful for an officer to take an individual into custody without reading them their Miranda rights? Secondly, if an individual is taken into custody, don't they have to be informed of the charges against them? |
