    CA- exceeding 100mph

    What is the name of your state? California

    Received speeding ticket yesterday at 0645 going south on I-5 for exceeding 100mph. The officer stated he paced me at 120mph (but my speedometer only goes up to 110mph!) He stated I got on a Magic Mountian Parkway and got all the way over to the left hand lane. Which I did safely, with my blinker on. He wrote my ticket as an infraction rather than a misdemeanor because he stated he didn't feel I was being reckless.

    I'm a nurse and I was on my way to work and her asked which hospital I worked at. Which I told him.

    -I recieved a speeding ticket in Oregen in 9/05 and have a my fault accident from 3/05. I'm not sure how long either of these stay on my record. Will they affect this case?

    I've read I'll get 2 points on my reacord for this, no traffic school, a huge fine and possibily have my license suspanded.

    -How much could my fine be and do you think my license will be suspanded, if so for how long and when does that start (do I need a ride to court) ?

    I've heard you can get limited driving privledges (like to drive to & from work) instead of it being totally suspanded; Is this true and how do I ask for it?

    -And how do you go about asking for a fee reduction?
    I was in N.Cali giving all my money to my family so I don't have but pennies to pay the fine with.

    Your license should be suspended for this. Your insurance will increase, if you aren't dropped by your insurance company.

    I have no idea why the officer didn't believe you were being reckless, your speed in itself is reckless. You could have killed someone. Emergency vehicles are not even allowed by law to drive that fast

    They will run your DMV and they will show. Whether they will affect your case...highly unlikely, but your speeding problem could pose a problem

This is correct. 2 point violations do not qualify for traffic school, the fine for a first conviction is usually no more than $500 + PA (penalty assessments) if he cited you for 22348vc. Just be aware that $500 + PA in California is over $1000.... and yes, the court can suspend your license. The DMV (for your first conviction) probably will not suspend, but you WILL have a court suspension. First convictions cannot exceed 30 days and no, you cannot have a restricted license. If you think of it, restricted licenses are for you to go to/from work....you were driving recklessly TO WORK. What's the point?

    See above. You were speeding TO WORK. Highly unlikely that they will grant a restricted license

    In Cali, courts are not swapmeets. Fines are generally statutory and they don't negotiate. You ought to be glad you're facing an infraction as opposed to a misdemeanor, which could have landed you in jail.

    Don't worry, they'll put you on a payment plan, but let your family know that you will need to be funneling some of that money back to the Superior Court of California, County of Los Angeles. Just be aware, that they have started a program to garnish your wages and attach bank accounts for people who aren't paying their fines. It's making people quite unhappy....

    22348. (a) Notwithstanding subdivision (b) of Section 22351, a
    person shall not drive a vehicle upon a highway with a speed limit
    established pursuant to Section 22349 or 22356 at a speed greater
    than that speed limit.
    (b) A person who drives a vehicle upon a highway at a speed
    greater than 100 miles per hour is guilty of an infraction
    punishable, as follows:
    (1) Upon a first conviction of a violation of this subdivision, by
    a fine of not to exceed five hundred dollars ($500). The court may
    also suspend the privilege of the person to operate a motor vehicle
    for a period not to exceed 30 days pursuant to Section 13200.5.

    Oh let me tell you SJ, the phone calls that I get are sometimes HILARIOUS as it seems that the Franchise Tax Board (CA's state taxing agency) went after those whose unpaid fines/assessments were rather old first. I got screaming and yelling about how dare we come after them after 4,5 6 and in one case 12 years....

    The amount that goes unpaid is unreal and FINALLY they've gotten the picture that a collection agency isn't going to do much, and we've stopped reporting 40509 (failure to pay) to the DMV, except for juveniles. People in LA don't seem to mind driving on a suspended, but they do mind getting to the ATM in the morning and there's no money there right after payday.

    OP....what is it that the nice officer cited you for anyway? What was the vehicle code on the ticket.

    And I forgot to mention (but I believe moburkes did)....depending on your insurance company your rates are going to go through the roof... or your policy is going to go bye bye.

    Whatever your needle is pointing at doesn't magically mean that's exactly how fast you're going no matter how heaving your lead foot has gotten. The needle doesn't somehow restrict the speed of your vehicle. The fact that you were going a speed unknown to even yourself is a very scary thought.

    Yes I'm a nurse. I'm a pediatric oncology nurse. I'm the daughter of racecar driver so I guess I was born with a lead foot. But it is possible to drive safely at high speeds!!! Maybe I should move to Europe where it's legal to drive at fast as you like.

    The California Vehicle Code & Section on my ticket is: 22348(b)VC-exceeding 100MPH Infraction. approx. speed 120 max spd. 65
    The CHP also said something about it being the time of day for max enforcement. What does that mean?

    Why would the court suspend my license if the Department of MOTOR VEHICLES will not?

    If my insurance will go up I'm glad I'm not with Farmer anymore! I guess I need to start riding my motercycle more often instead since I drive it under the speed limit.

    Yep, it is possible, but not when the little old lady moves her car into your lane, or another person in traffic makes a stupid move. You don't, however, have the right to drive, and you don't have the right to drive in excess of the speed limit.

    What country in Europe doesn't have a speed limit?

    No, perhaps you need to begin to utilize public transportation because sooner or later you are going to kill someone with all this speeding you are doing (and obviously so proud of it).

    Maximum enforcement periods just happen to be the times when everyone is out looking for people trying to endanger the lives of innocent people just trying to get to work or get their children to school or just mind their own business lawfully... I'm sorry, but the levity that you give to this situation is just sickening to me. Absolutely sickening.

    I drive safely at any speed. I just drive so much that I choose to limit the amount of time I have to spend in the car. I put between 3 to 5 thousand miles on my car each month. I drive all over Central & Southern California. And no driving is not a hobby. It's just boring.
