Calif Codes for Right to tow a vehicle


What is the name of your state? CALIFORNIA

I need to find out what codes give me the right to have a vehicle towed at the owner's expense?

Our situation; We live on private property, in a gated apartment complex. Each resident has a designated parking space, and there are several 'extra' spaces for a secondary vehicle owned by the renters. "guests" are to park outside the gated complex.

Several times we have come home and some @$$ is parked in our space. We have notified the manager, written notes asking these people to not park in our space and threatened to tow their vehicle - I have also made my own very sticky notes and pasted them on the windshield at driver's level - and still this person parks in our space!! I'm ready to flatten tires if I have to!!

I need to know what code sections give me the right to have the vehicle towed at owner's expense. If necessary I will pay to have it towed and sue the person in small claims court...

Any Ideas?? Thak you!!

Hey, Ukiah! Long time no hear! Nice to see you again.

The reason you're not able to find anything about towing in the State Statutes is because towing laws are not statutory. They are "local" laws; i.e., Ordinances or Municipal Codes that are enacted by each County.

So, in order for me to help you, I need to know which County you're talking about.

Hey IAAL,

Glad to see you too! I'm in San Benito County - I've tried online to find local ordinaces, Municipal Codes, and whatever else I could think of, and nothing... The local police state to me that I live on private land and that the manager is the one who has to take action - You know me, I can't stand waiting around forever for someone else to get off their duff...

Any help/ Info is definately appreciated (and needed).

You're right . . . I searched like crazy for you, and nothing!

Apparently, San Benito is not a "monied" county; i.e., it doesn't have enough money to have a website that shows it's Municipal Codes or Ordinances. So, you're going to have to visit your County Government offices and ask for the Municipal Codes concerning parking and signage requirements for towing.

Anyway, I thought you were in Riverside County. When did you move to San Benito, and why?

If you want another legal research "Practice Guide" CD for your computer, give Mary your new home address for me, and I'll send it out to you. Or, if you still have my e-mail address, you can write directly. The last one was issued back in June, and I'm expecting a new one very soon.
