california-speeding ticket question

Here is the scenario:
So far, I have collected a sum of 3 speeding tickets. The First is non-void because i went to traffic school. the 2nd i paid for completely without any hassles. Now i received my 3rd speeding ticket which according to the DMV, (who is supposed to delete the first ticket off-the-record if you choose to go to traffic school and complete it) means i am supposed to have 2 on record.

I am faced with a dillema. the 3rd ticket, I received no courtesy notice to pay or appear in court, although i DID sign the ticket stating i would promise to appear. It has been a while (more than 3 months) So now i believe i am faced with an FTA. I want to know what my options are as of now? Because i procrastinated on the ticket and I want to get it taken care of.

What penalties will i likely be facing?

Who do i contact to see the penalties i am facing?

And will it likely be fined or jail time?

Thanks!

"What penalties will i likely be facing?"
*** If a FTA warrant has been issued, you are subject to arrest.

"Who do i contact to see the penalties i am facing?"
*** The court.

"And will it likely be fined or jail time?"
*** Depends on how good the judge feels that day.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

anyone else with more experience care to comment a bit further than 5 words?

really, i didnt know the f.t.a. means a warrant -might- be summoned on my person. let me further elaborate..

•what usually• happens if you procrastinate on a ticket, then decide to pay up. Not what is supposed to happen under state legislature of penal code 12423142.355, or what SHOULD happen. because i could have established that information for myself very easily by contacting city hall. I'm asking for personal experiences. what happened to you (if it has, if not then you shouldnt answer the questions) when you procrastinated on a speeding ticket payment or FTA.

so, In your words, i should contact the court to see if an arrest warrant has been established. And also, to see if my ticket has been processed. Or why i was not receiving a courtesy notice to pay. Or not receiving a reminder to appear in court like i did the other 2 times. Or also why i have been innocently pulled over 3 times discriminantly, since the speeding occurred, only to find my 'alleged' clean record and walk away.. i would like to know somehow if i have a summons issued. i dont want to walk around in fear of a speeding ticket giving me an arrest warrant for going 56 in a 45. it's rediculous.

so, there is no answer to what penalties i will be facing, you just say "depends on how the judge feels that day" because you have not a more detailed answer? i mean obviously, just like the other hundred million occupations in the world, it all depends on your attitude and how 'good' you feel when you wake up in the morning and drink your coffee. whats more likely and whats not likely in this situation.

Ok child, let me hold your hand!!

"really, i didnt know the f.t.a. means a warrant -might- be summoned on my person."
*** And exactly what did you think a "Failure to Appear" warrant meant!! Of course, if you fail to appear on the charge, a bench warrant is issued for your ARREST.

"what usually happens if you procrastinate on a ticket, then decide to pay up."
***If you 'procrastinate' past the date that you were supposed to appear, a bench warrant is issued for your arrest.

"Not what is supposed to happen under state legislature of penal code 12423142.355, or what SHOULD happen."
*** All we can tell you is what SHOULD happen. We can't foretell the future, or see any and everything that might arise that could affect the warrant being issued. We can only tell you what NORMALLY happens. Hell, you could die before the scheduled hearing...... huh??

"because i could have established that information for myself very easily by contacting city hall."
*** Then why the hell did you waste our time with your inane 'what if' question??

"I'm asking for personal experiences. what happened to you (if it has, if not then you shouldnt answer the questions) when you procrastinated on a speeding ticket payment or FTA."
*** Sorry, but this is a LEGAL site and you will get LEGAL advice on your issue. This is not the "what happened to you" site. Post your question over there if you want a history lesson.

"So, In your words, i should contact the court to see if an arrest warrant has been established."
*** Not necessarily. Next time you are driving down the street and see a patrol car, shoot him the finger. Or squeal your tires leaving an intersection. Or roll down your window and say, "Bet you can't catch me!", then speed away. I am sure that the officer will be glad to tell you if you have any outstanding warrants when he runs you.

"And also, to see if my ticket has been processed."
*** Assume it has been. Only the extremely lucky have their tickets lost.... and you don't seem that lucky.

"Or why i was not receiving a courtesy notice to pay."
*** You got one. It is called a citation. The officer gave it to you.

"Or not receiving a reminder to appear in court like i did the other 2 times."
*** Maybe the court assumed you were a responsible, mature adult.

"Or also why i have been innocently pulled over 3 times discriminantly, since the speeding occurred, only to find my 'alleged' clean record and walk away."
*** Nobody gets pulled over three times 'indiscriminately'. Unless you look like Charles Manson!!

"i would like to know somehow if i have a summons issued. i dont want to walk around in fear of a speeding ticket giving me an arrest warrant for going 56 in a 45. it's rediculous."
*** Then take care of your 'business'.

"so, there is no answer to what penalties i will be facing, you just say "depends on how the judge feels that day" because you have not a more detailed answer?"
*** Nope. The reason I answered that way is that there is a lot of leeway in what punished can be dealt by the court. And when we do offer the range of punishments for a charge, some of the idiot posters plea it down to a lesser charge (and less punishment) then thumb their noses at the forum for 'being wrong'. The only correct answer to your question is, and remains, as I previously stated.

"i mean obviously, just like the other hundred million occupations in the world, it all depends on your attitude and how 'good' you feel when you wake up in the morning and drink your coffee. whats more likely and whats not likely in this situation."
*** Okay, you tell us your EXACT complete driving history, every ticket and every punishment received. And tell us the EXACT charge you face in this case. And you tell us whether you are going to try to plea it down************** and we will tell you what you MIGHT get.

Do you understand all that?? Good.
You're welcome!!
