Can I beat this ticket?


What is the name of your state (only U.S. law)? Tampa, Florida

I need advice on how to beat this ticket I was falsely awarded. On my wedding day I had a few errors to run I was driving down the highway where the speed limit was 55. I was excited about the day and traveling about 60 or so going the speed of traffic flow. At certain points along the highway (It was State Road 54 headed East) there are traffic lights. As I approached the light was turning yellowed so I slowed down and stopped at the light while I was stopped at the light all of a sudden there was a state trooper behind me, he hadn't had all his flashing lights on he just gave me a quick "beep, beep" Pull over to the side. After he approached the car he told me I was speeding doing 82 miles per hour. There is no way I was going that fast and when he pulled me over I was at a stop light. He had not been behind me prior to that or if he was there was no flashing lights. So I'm not sure but I was doing maybe 60 at the height of my speed. I didn't want to argue it was my wedding day so I just gave my information and signed the ticket and left. He told me he would give me a break and list the speed limit at 60 on the ticket so it wouldn't be too bad (That zone was a 55 mph zone). He used some kind of radar to clock who he thought was me. Is there any way I can beat this false ticket? He listed my car on the ticket as black while my car is blue. My court date is coming up while I was speeding only slightly there is no way I was going 82. What can I do to beat this ticket???

I believe I would be hiring a lawyer. You need some good legal advice.

If you do not want to hire a lawyer, then must attack the credibility of the cop when you have a trial on this speeding charge.

Advice Please


I'm not sure how my other case is relevant to this one at all, but I appreciate your comments. I'm really trying to get advice on what I can do. Does the fact that the cops lights weren't on until he pulled up behind me and that he listed my car as the wrong color give me any leighway? What about the radar gun? Could it be that he clocked another car instead of mine? There was no way I was going 82. And finally any advice on what I can do to win this case?

Reading other posts helps determine the mindset of the poster. We get many serial posters to this site, always in trouble, never did anything wrong.

Perfectly legal.

It's leeway and maybe. The color issue does not prevent you from presenting a valid defense to the citation but in the hands of an experienced traffic attorney, it can be used against the officer.

Virtually impossible to prove. You could subpoena his notes and read the officer's observaions of the traffic infraction. Sometimes an inconsistency can be found that can help you.

Depends on how much knowledge you have of how traffic court works. Go the the court and what the proceedings, you will learn how the court works and what defenses are successful. Hiring an attorney will be your best bet, they already know the judges and what they want to hear.

First no one here is a radar expert so if you want to understand how to defend against Radar evidence go radardetector.net there are people there who can tell you what the state (in this case the officer) must do to sustain a conviction.

You do not have to prove ithe officer measured another car's speed, the officer must show beyond a reasonable doubt he only measured your car if you hold him accountable which most people do not. In a number of very small instances can the officer say with 100% certainty he only measured your car and nothing else. If you understand this you can mount a defense and possibly win.

Then they is always the option in FL where there are Traffic lawyers who claim they can get any ticket dismissed. I think if you do a search on the subject you will find a few of these out there.
