i was charged with careless driving. as i was driving, a spider landed on my face and was crawling up my face. instinctively, i shut my eyes for a second and tried to swat the spider off my face. then i hit a parked car. (stupid mistake, i know.) no one was hurt, but there was damage to my car and the parked car. does this accident qualify as careless driving?

i looked up the definition of the offense and it said, "39:4-97. A person who drives a vehicle carelessly, or without due caution and circumspection, in a manner so as to endanger, or be likely to endanger, a person or property, shall be guilty of careless driving."

i don't believe i was driving carelessly according to this definition, but please let me know if i am incorrect.

In my interpretation, you were driving carelessly. Closing your eyes while driving and swatting at your facr is careless, regardless of the reason. Due to this, you struck a parked car. You did exactly what may happen when one drives recklessly, further proving the point.

Of course this is only my worthless opinion. :D
