Charged with default judgment though I responded....What is the name of your state?Michigan speeding ticket. Called after receiving it and was told to send $80 and the ticket. Did so and about a month later received a card saying that I owe $95 because I did not respond in the allotted time and a default judgment was made. The check for the $80 never posted and the court says that they did not receive it. I have photocopies of the ticket and check - is there anything I can do about this? I see nowhere on the notice of judgment where any contesting or appeal is possible. |

| Send it return receipt requested next time, that doesn't prove you sent payment but it would probably be sufficient to get them to drop any late fees if they claim they hadn't received your payment. You have two choices now, pay the extra $15 or spend a lot of time trying to convince them that the check really was in the mail. I have no idea what their policy on forgiving late fees is but it's likely that they hear your type of story 10 times a day. Which isn't to say that your payment wasn't really lost, just that after you hear the dog ate my homework story a couple dozen times you tend to become rather skeptical. |
