cited for 65mph while on cruise control at 55mph.What is the name of your state? California I was driving 55 on a 55mph hwy. I had my cruise control on. I was goin up a hill and the CHP was going the opposite direction. He was on top of the hill before I got there. After I passed him, I saw him turn around and pulled me over. He said he clocked me driving more than 65mph. How could that be when I was on cruise control at 55. I didn't know that I had the right to see his radar gun. But I also read an article saying that you can subpoena its calibration record and that if its not calibrated within 10 days then it's not accurate. Is that true? Is it legal ofr cops to clock you if they are going the opposite direction? If so, how can I subpoena that record and how can I contest that ticket? Or where can I find their guidelines about the legal ways they could clock you? Thank you. |

This will lead to nothing since CHP is very good at keeping records and correctly calibrating the radar units. "I was driving 55 on a 55mph hwy." I would strongly suggest that you check your speedometer. You can do this between milemarkers on the interstate. If it is off then have it certified and present this in court. "how can I contest that ticket?" Plead not guilty and request a trial. |
