Delayed court for careless driving

Hi, I was pulled over for a careless driving violation awhile back, almost 2 months. The court has yet to give us a court date. I do have a lawyer, but nothing is working. We are told no court date due to the fact the officer was on vacation or sick leave. This delay is costing me or rather will cost me my position with my company, but it is costing me my sanity. I've been having thoughts of possibly suing the town for delaying the process I'm due. I guess my question is do I have a chance at suing the town? Ive lost a good deal of pay, and wish it would all stop.
