Did 5 over, got a ticket for 12 over. NYWhat is the name of your state? NY Buffalo, NY to be exact. No plea bargain. No ticket reduction. Either innocent or guilty, and you are guilty until proven innocent in that court. Here is what happened: It was late (2:30am) and I was comming home after a pre-4th of July party. My passenger and I were 100% sober. I turn onto a street and I notice an officer tailing me. My eyes dart to the speedometer, it says 30mph. She starts to tail me a bit close and I figure she is in a hurry, so I step it up to a more reasonable (and generally accepted) 35mph. This goes on for about 5 blocks until I hit a 4 way stop sign intersection. At the other end of the intersection is another officer, he slowly moves through the intersection (taking about 15-20 seconds) and is scanning the street looking for somebody. I figure that both officers are looking for a criminal. I slowly accelerate past the intersection, being careful not to do anything dumb and resume my 35mph. A few more blocks go by and I put on my left turn signal...immediately the lights go on the trailing officer's car. I pull over, roll down my window, and place my hands on top of the steering wheel. Then another officer's car darts in front of me with the lights on closing me in as if to block my ability to speed away. This officer jumps out quickly with a flashlight pointed at me yelling "PUT YOUR HANDS UP". Both officers come to the vehicle, one on each side. They are watching my passenger and I very closely as if we were armed. I ask "what is wrong?". The officer responds asking me if I know the speed limit. I was nervous and said 35, she corrected me informing me that it is 30. She asked for my license (did not ask for registration) and asked my passenger for his id. She then said that I was going 42mph and that she was trailing me in hopes that would make me slow down. Confused, I said that according to my speedometer that I was going only 35mph, I explained that I checked it and was careful about it because I did in fact see her trailing behind me. She told me that I was still speeding and if my speedometer is broken then she will impound the vehicle. Intimidated, I kept my mouth shut. Her and the other officer looked at our licenses, the other officer nodded and quickly took off in his vehicle (with some tire squeel). The officer came back in less than 3 minutes with a ticket for doing 42 in a 30 zone. The next morning I heard from the neighbors that a wacko was on our street with a gun late last night stating that he was going to shoot "all you people". I was pulled over late last night one block away from my home. I honestly believe that I was pulled over not for speeding, but because I was in the wrong place at the wrong time. Seeing that I look and act like a good citizen (think Eagle scout) it was pretty obvious they pulled over the wrong car. The ticket was probably given as an excuse for scaring the crap out of me and my passenger (my brother). Finally, I was not, I repeat I was not going 42mph. I know I was going 35. I also had the luck of running into one of those radar stations (your speed is...) and my speedometer is dead on correct. I need to fight this, but I have no evidence of anything. My word will mean nothing over the officer's word and the whole thing will be a waste of time and energy. However, I can't plead guilty to something that I am not guilty of. | Anybody have any suggestions? Also since two officers were involved do both have to show up in court? I have a feeling that only one will. |
