A friend of my was driving through AL (she lives in KY) and was pulled over and got a DUI. She blew a .07 on the breath test. We know that the legal limit is .08. Would you recommend hiring a lawyer for this? She has talked to a lawyer in AL. He wants a $1000.00 dollars up front. Would she be wasting her money on this lawyer. Can she count on this being dropped to reckless driving because she blew below the legal limit. In other words does she really need a lawyer?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Basically, you should get an attorney. There are plenty out there that do not charge so much. try attorneypages.com.

Plea bargaining down to reckless driving may help, as a last resort. But remember, your friend could have killed someone. Obviously this person was driving in such a fashion as to alert police of obvious alcohol consumption.
