I have the same situation, only different states. I live in NJ, and got a NY-state traffic ticket.

I was coming across a bridge and at the end thought I was pulling into a cash lane, but it was an EZ-Pass lane. So I got a ticket for that.

Like Kaos, I am wondering if there are any points associated with such a violation. It'll be quite an annoyance to go back to NY courts just to plead not guilty, in addition to court fees I'd have to pay. I'm more than willing to plead guilty and pay the fine if I don't receive any points from the ticket. If I do, though, then I'm pleading not guilty.

Does anyone know if there are any points associated with this sort of violation?

Since I got the ticket right there, and was asked to show license, etc (the Auto-pay toll had a gate that kept me from driving right through), someone I know (wife of a police officer) says it's a moving violation, and that there are points on it.

A friend has told me if you drive through the lane (without a tag), they send you a ticket based on a photograph taken, but he suggests that you can't get any points that way since they don't know who it is driving the vehicle.

I'm sending my ticket in tomorrow pleading not guilty in hopes of getting out of any points on my license. I'm likely to pay way more in court fees than I would have if I just paid the ticket, but those points really hurt insurance rates, so... Wish me luck.

I'm fairly sure that NY EZPass violations are 2-points if they have your license info, otherwise, if its photo-only, its just a fine ($50, I believe).
