Entrapment in a School Zone


What is the name of your state (only U.S. law)? Alabama
I live in Smiths Station Ala, and went to Opelika and was traveling on a road I never been on before. Posted speed limit is 45. As I get to the 45 mph sign I see a Police car sitting on opposite side of the road (which my eyes naturally focus on him) by doing this I did not see a School Zone sign that is 30-40 ft in front of 45 mph sign. (for placement he was just inside the beginning of the school zone sign) There is no school in sight, traffic was light, no kids and no buses around. School zone time is from 7am cst - 8:30am cst. Time of stop was 7:15 cst. Needless to say I was pulled over, and he asked me if I knew why I told him no. He said I was speeding in a school zone doing 43 mph, and asked if I knew it was a school zone,(with a confused look) I told him no sir, that I was from another town and was not familiar with the street. He said if I go down and make a left there is a school on Jeter street (which looking where he pointed, I could still see no school, or kids, or buses) To shorten it up, instead of giving a warning he did cite me. I was just curious if I had a chance at fighting this in court. With him sitting right at the school zone sign but on other side of the street, which takes your focus off the sign, and puts it on him and on my speed odometer to make sure I wasn't speeding. Any help will be greatly appreciated. Thanks

You MUST be kidding. You want to blame the officer for your inattention? Maybe you shouldn't be driving if you are so easily distracted. It would make the kids safer!

Fight the ticket. Go to court and tell the judge that the police car was a huge distraction and because of that, you did not see the sign. Wait until the laughs die down, then listen to what the judge tells you.

I will be taking a collection from the regulars today, the OP just broke the Free Advice Lame-O-Meter. This site is getting expensive with the Free Advice crystal ball and Free Advice Lame-O-Meter getting broken all the time.

So if because you were looking at the cop you ended up hitting and killing a child, would you still consider it entrapment when they charge you for vehicular manslaughter?
