Expired license Vs no lisence

What is the name of your state? New Jersey

I was caught driving with an expired Australian driver's license. The police officer put on the ticket that I was driving without a license. What is the difference? How should I deal with this?

My other problem is that my visa ran out in December and although I am planning my return 5 days after the court date (Jan 12) I am worried that they will bring up this issue and try to deport or detain me, is this possible?

I can't afford a lawyer.

I have been advised that I should talk to the prosecutor and try to settle before they get into the visa issues, but I don't know how to go about this or what to say.

Please help

What kind of advice is that?

Just tell it like it is. Ask the prosecutor to allow you to plead to a lesser charge.
Ask him what the penalties are for each. Ask, ask ask.

Because the license is expired, it is not valid. Hence, "driving without license".
