I was stopped at a traffic light several cars back and directly behind a large white door delivery truck. My son was in the front passenger seat. As I was waiting for the light to change (but I could not see it, truck in front of me was to large to see), I was getting something out of my purse and my son said "mom, time to go", he had noticed that the delivery truck ahead started to move. I looked up and put my foot on the gas pedal at the same time and bam, I rear-ended the delivery truck. Not a scratch to that truck, but totaled my car. I called the police thinking that was the right thing to do (??) and he issued me a ticket for failure to control vehicle speed to avoid collision. I disagree, I was in control of my car the truck just stopped. I think he was slowly moving forward but not as a result of a green light, they said the light was red. Do you think I have a valid argument against "lack of control"? |
