| this should be simple, I think... I'm going to traffic court to fight a ticket for "not stopping" at a 4 way stop sign. I DID completely stop for a fraction of a second and then sped on. Apparently the cop was not watching closely enough, and missed the stopping part. How do I convice the judge, that the cop "mis-saw"? This all happened, in California. Thanks, (and I did really stop.) |

reply to speeding ticket it may be simple-- your word against his--- plead not guilty--- demand a jury trial--the judge will always favor the cop unless you have a witness---a jury will not--a jury trial will most likely end the affair, but it could cost you more if your found guilty-- but whats the worth of justice |

| Why would it cost more if I lose to have a jury trial? Do I have to pay for the jurors? |

| I see lots of people are reading this thread, but I'm not getting much help. I was thinking that this would be fairly easy, since the cop has to "prove" that I did not stop. I guess he will have no proof, and it will come down to my word against his. This does not seem right. In any case, my defense (other than saying I was in the car, and 100% sure I stopped) was going to question his vision and ticketing "history". Some questions I have thought up are... Has anyone ever disputed one of your tickets before? If so have any of those tickets been dismissed? And if so, how many times has this happened? My next line of questioning might be to question (or at least cast doubt) that he was paying full attention to me... I'm pretty sure cops are trained to keep an eye on their back. Maybe he was checking his mirrors, or looking over his shoulder, or maybe completing paperwork, and that is why he did not see me stop. That is really what I think must have happened, since I REALLY did stop. Any other ideas or advice will be great appreciated. Thanks. |
