follow to close avoid accident


Georgia 40-6-49. I may have been able to stop. I chose rather to avoid the vehicle (in front of me) that hit the vehicle in front of her, which happened to be a county Patrol car. In doing so I ended up in a ditch. Had to have my vehicle towed to get a new tire, drove it home same day. Reasons for avoidance: I knew there were kids in car in front of me; Car in front was a Lexus SUV...$ pricey to fix; It probably stopped a chain of events behind me. There is no claim I am making to insurance, have I got a chance of getting this one thrown out?

Sure. Explain to the prosecuter that you could have stopped but saw that the vehicle behind you could not. Since you did not hit anyone they will probably be willing to drop. If not you have the option in GA to plead not guilty and request a jury trial. Then you will have a second shot at getting the prosecuter to dismiss.
