Question

getting points dropped


in the state of ohio in belmont county, i got pulled over for speeding 80 in a 65. i stopped at the court house and talked to a lady at the front counter and asked here how i could go about dropping the points assosiated with this ticket. she told me that i could not go to driving school, but i could write a letter to the judge (when i pay the ticket) asking him to lower my speed by 5 mph. she said by doing this i would not have any points on my record because speed up to 10 mph and under do not result in any points. i then asked if writing the letter would garantee me not to recieve any points, and she said yes since i was only concerned with the points and not the fine. does this sound logical or am i being tricked into pleading guilty and getting the points anyway?

Why do you need the points dropped? Are you in danger of suspension?

being my first ticket, and being 20, i'm afraid my insurance will go up.

"Points" have no bearing on your insurance, that's how the DMV decides when you need to have remedial instruction or suspension as a repeat offender. Insurance companies have their own scoring. They typically count all moving violations but sometimes double count things like very high speed or reckless/careless citations. If your insurance paperwork doesn't explain this, your agent or company customer service usually can.

That's what I thought, and he is correct. Insurance companies charge based on the violation, NOT the points associated with the violation. They will surcharge your policy regardless of your age, or the fact that this is your first ticket. The actual surcharge is the same for all drviers, its just that, being young (and being a guy, if you are male), your premiums are already higher, so the surcharge is based on a higher percentage.

so i should try to get the charges changed to a non moving violation? and how should i go about doing this, a letter to the judge, going to court, or another option?
