Hit and Run


I need help. My friend was driving home last night and his transmission went out, so he parked his car on the side of the road. The cops showed up at his house at 5am this morning and gave him a ticket, saying he was involved in a hit and run and was required to show up in court on Friday. The only evidence they have is skid marks next to where he parked his car. It wouldn't be a big deal, but he's on probation, and since a hit and run is a misdemeanor, its a violation of his probation. I need any advice I can get to keep him from going to prison.

I am kind of curious of who they are saying he hit. you have to hit something first before you can run. Leaving you car on the side of the road unattended where prohibited is a different issue.

Also, does he have damn on his car? Maybe he was hit and the other person ran?

Exactly, for him to be identified as a hit and run suspect I would assume that someone would have to have identified his car as being involved in an accident. Once his car is located, the location and severity of the damage to his vehicle matched to that if the other vehicle/object would confirm or refute the accuracy of the witness statements.
Also, if he had left his car at the scene of the accident and assuming it was another car that he hit, the other car is no longer there, it sounds to me that the other driver did more of a "hit and run" than your friend!

i apologize for not being clear. the police are saying that he hit a parked car. there is no damage on his car other than a blown tire from hitting glass when he pulled to the side of the road.

If he is on probation then he should have a lawyer, his lawyer should know what to do.

Simply put, hard to have a hit and run and not have damage, arguable not damage no foul, and no claim.

Make sure you take picture of the car to show no damage on the car.
