hmmmm?ok[SIZE=3]ok[/SIZE] here's the story .my hubby got pulled over for driving to close .in texas.he has a c/b and alot of truckers and he himself were saying no no's about the cop or any cop.anyways the next thing u know he gets pulled over again and the cop hands him ticket for disorderly conduct.how in the world does that happen?i listen to truckers say all kinds of foul stuff on cb's about everyone and cops .anyadvice?and what is concequences of a disordely conduct?never heard of someone getting one in this way . ![]() |

| Though Texas statute actually has TWO types of disorderly conduct, I assume that he was charged under the following: "§ 42.01. Disorderly Conduct (a) A person commits an offense if he intentionally or knowingly: (1) uses abusive, indecent, profane, or vulgar language in a public place, and the language by its very utterance tends to incite an immediate breach of the peace; (2) makes an offensive gesture or display in a public place, and the gesture or display tends to incite an immediate breach of the peace; (3) creates, by chemical means, a noxious and unreasonable odor in a public place; (4) abuses or threatens a person in a public place in an obviously offensive manner; (5) makes unreasonable noise in a public place other than a sport shooting range, as defined by Section 250.001, Local Government Code, or in or near a private residence that he has no right to occupy; (6) fights with another in a public place; (7) enters on the property of another and for a lewd or unlawful purpose looks into a dwelling on the property through any window or other opening in the dwelling; (8) while on the premises of a hotel or comparable establishment, for a lewd or unlawful purpose looks into a guest room not his own through a window or other opening in the room; (9) discharges a firearm in a public place other than a public road or a sport shooting range, as defined by Section 250.001, Local Government Code; (10) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm; (11) discharges a firearm on or across a public road; or (12) exposes his anus or genitals in a public place and is reckless about whether another may be present who will be offended or alarmed by his act. (b) It is a defense to prosecution under Subsection (a)(4) that the actor had significant provocation for his abusive or threatening conduct. (c) For purposes of this section: (1) an act is deemed to occur in a public place or near a private residence if it produces its offensive or proscribed consequences in the public place or near a private residence; and (2) a noise is presumed to be unreasonable if the noise exceeds a decibel level of 85 after the person making the noise receives notice from a magistrate or peace officer that the noise is a public nuisance. (d) An offense under this section is a Class C misdemeanor unless committed under Subsection (a)(9) or (a)(10), in which event it is a Class B misdemeanor." As for possible punishment: "§ 12.22. Class B Misdemeanor An individual adjudged guilty of a Class B misdemeanor shall be punished by: (1) a fine not to exceed $2,000; (2) confinement in jail for a term not to exceed 180 days; or (3) both such fine and confinement. § 12.23. Class C Misdemeanor An individual adjudged guilty of a Class C misdemeanor shall be punished by a fine not to exceed $500."
__________________ There are at least 17 lawsuits (!!) filed in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.7M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! | My dad once told me he got a speeding ticket in Texas for going 1 mph over the limit. It didn't help that he was driving a brand new Oldsmobile and pulling a 30 foot travel trailer with Illinois plates. I drove a semi for a couple years and agree to what you state they say on their cb's. Based on Halkert's posting I would fight the ticket. I want to add that there are also laws for the use of cb radio's that are fcc, state or federal that govern language. |
