Hold a CDL and got a ticket


What is the name of your state? Texas

I'm required to hold a Class B CDL for my job at school, and I got a ticket today on my motorcycle. Texas passed a law in September 2003, that anybody that holds a CDL can not take defensive driving or deferred. Is this something that a judge can reverse and allow me to take DD or deferred? I explained to the officer that I need my job to pay my rent/bills/etc for my last semester of school, but he told me he couldn't give me a warning for the speed I was doing (90 in a 70). The officer seemed as if he didn't want to give me the ticket, but he had to. In the box next to my drivers license number, it has a spot titled "C.D.L." and he left that blank. He also put tomorrows date on the ticket. I know there is a slim chance to get out of the ticket on an error, but my main concern is keeping the ticket off my record so I can keep my job until I graduate. Can a judge allow me to take deferred? I know being a young college kid doing 20 over on a sportbike will not help my case.

Call the clerk of court and ask if you are eligible for traffic school or a deferment. Since the officer left it off the ticket it may just go through.
Some courts are not rigorously enforcing the new rules anyway.

I'm not going to lie to the judge and tell him that I wasn't going that fast, because I was. I'm willing to pay the fine and take the hit to the wallet, but I need to keep my job. I know this is my fault, but I don't want to lose my job over 1 mistake. My record is clean and I've never had any run ins with the law.
