Question

I believe this was a false arrest...pls help

I live in Rhode Island and deliver pizza...while delivering on Monday night I went down a street and to get to the point there was a vehicle blocking the road they wouldn't move and were yelling and being crazy because it was a windy road I couldn't back up so I drove over their lawn. (obviously wrong but that's not the prob.) On Sunday night I was arrested for this incident and they towed the car I was driving that night which wasn't the car I was driving on Monday night. I was held at the local police station overnight and taken to court in the morning. They had towed my car even though it was on private property and I had requested to leave it there. There now is significant damage to the bottom front of the car because they towed it with a regular truck and not a flatbed like i told them it needed to be. Also, after being fined for $250.00 damage to someone's yard, I went back to check and there really is nothing you can't even tell I drove over it. What should I do? I have been charged with reckless driving and thry arrested me due to the fact that supposedly on Monday they issued a warrent for my arrest. Does this sound right? I am not sure if there is anything I can do? I pleded not guilty in court and was released on bail and have to go back to court.

I agree with HomeGuru.

However, I do add the following... if damage was done to your car due to the tow, you can pursue compensation for the damages from the tow company.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

If Halket says it's not false arrest it's probably not. Here's the kicker. What can they prove? Did the police to out there to investigate while their car was in the middle of the road? Get some pictures of the flawless lawn. Make them prove their case. As for towing the wrong car, they just towed whatever car you were in when they arrested you. Why couldn't you back up? Sure, it's a windy road, but I wouldn't think one would need more than two lanes in which to turn around even if they're not straight.
